Two brothers charged in a brutal assault caught on camera will spend one year in jail after each pleaded guilty to one count of aggravated assault and one count of assault causing bodily harm.

The judge accepted a joint submission from the crown and defence of one year in jail  followed by a 10-year firearms ban. The brothers received one year for the aggravated assault charge and six months, to be served concurrently, for the assault causing bodily harm charge.

Darren Hinds, 29, was originally charged with two counts of aggravated assault and one count of uttering threats to cause death. The uttering threats charge was dropped. Darcy Hinds, 26, was charged with two counts of aggravated assault.

The two pleaded guilty Wednesday afternoon in Saskatoon Provincial Court to the Nov. 28 assault that was caught on video and posted to YouTube. The video has been viewed over 71,000 times.

Defence lawyer Brian Pfefferle told reporters outside of court the two brothers took responsibility for the charges and cooperated with police. He said an aggravated assault conviction typically involves a sentence in a federal penitentiary but says the level of cooperation in this case contributed to a lower sentence.

“Sort of take it on the chin, that’s what these guys did. Some credit needs to be given to the way they conducted themselves. Although I appreciate people are likely angry at watching the video,” Pfefferle said.

Footage of the assault shows two people being attacked on the 900 block of Central Avenue. The Hinds brothers are seen kicking the victims in the head after they’ve fallen to the ground.

The victims, a 32-year-old man and a 43-year-old man, sustained serious but non-life-threatening injuries, according to police.

Both brothers are former University of Saskatchewan Huskies football players. Saskatoon police initially requested warrants for their arrests in December before they turned themselves in a few days later.
