A judge has delayed his sentencing decision in the case of Justin Gryba, a Saskatoon man convicted of child porn offences in 2012 and who pleaded guilty to more charges earlier this month.

Gryba was scheduled to be sentenced Thursday at Saskatoon’s Court of Queen’s Bench after pleading guilty March 18 to four counts of making and possessing child pornography.

The man, who was sentenced to two years in prison after pleading guilty in 2012 to child porn offences, was charged again in 2014 after police opened encrypted devices seized during their initial investigation.

The additional seven charges included possession of child porn, accessing child porn, making child porn and voyeurism.

Gryba originally entered a not guilty plea after the new charges were laid. He argued he couldn’t be charged with the same crime twice, but a judge denied the argument.

Three of the seven new charges were stayed, and Gryba pleaded guilty to four offences — two counts of making and two counts of possessing child porn.

Gryba’s defence lawyer argued Thursday that Gryba should be released. He was receiving help before the new charges were laid by attending a sexual offender education group.

“Further jail time would only prohibit rehabilitation,” his defence lawyer said.

Gryba has been in custody since the 2014 arrest and, including his initial sentence, has so far served just over 28 months behind bars.

The Crown asked for him to serve two-and-a-half more years.

The judge reserved his decision until April 15.
