1. TO APPLY to be considered as a potential participant in the CTV Saskatoon Fitness Challenge (“Challenge”), simply send an email to saskatoonmorrninglive.@ctv.caincluding the subject line “CTV Saskatoon Fitness Challenge Application” and also including your name, residential address, age, ten digit day and evening telephone numbers and e-mail address.  Limit of one (1) application per individual. If it is discovered that you attempted to apply more than once, all your applications may be void, in Bell Media Inc.’s exclusive discretion.  Applications shall be deemed to be submitted by the authorized account holder of the email address submitted at the time of application.  “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.   Illegible applications are ineligible.  Application emails may be sent starting at 8:00 A.M. Central Time (“CT”) on March 23, 2015 and ending April 3, 2015 at 12:00 P.M. CT (the “Application Period”).  No purchase necessary.  Void where prohibited.

    2. The Challenge sponsors are: Bell Media Inc. (“BMI”) and Goodlife Fitness Centres Inc. (“Goodlife”) (hereinafter together referred to as the “Challenge Sponsors”).

    3. To apply and to be eligible to be a potential participant, applicant must be a citizen or legal permanent resident of Canada or an aboriginal who permanently resides within the territorial boundaries of Canadaand must also be a resident of Saskatoon and eighteen (18) years of age or older. Employees and their parents, siblings and children, and persons domiciled with an employee of the Challenge Sponsors, their respective agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to apply.

    4. Applicants who are selected as potential participants in the Challenge (“Potential Participants”) must be available and willing and able, at his/her/their exclusive cost and expense, to actively participate, in-person, in the participant selection process which will take place at CTV Saskatoon, 216 First Avenue North, Saskatoon, Saskatchewan S7K 3W3 between the hours of 9:00 A.M. CT and 12:00 P.M. CT starting on April 6, 2015 and ending on April 9, 2015 (the “Selection Period”).  Potential Participants may be required, in BMI’s exclusive discretion, to participate in the participant selection process one (1) or more times during the Selection Period.  Potential Participants who are selected as participants in the Challenge (“Participants”) must be available and willing and able, at his/her/their exclusive cost and expense, to, among other things, attend and actively participate in one (1) hour long training sessions at the Goodlife facility located at Goodlife Fitness, Circle Centre Mall, 3510 8th Street, Saskatoon, Saskatchewan S7H 0W6 (the “Gym”), at 12:00 P.M. CT on each Tuesday and Thursday from April 14, 2015 to June 11, 2015 inclusive.  Goodlife will provide each Participant with a pass for the Gym, which pass will be valid for the ten (10) week period commencing April 14, 2015 and ending June 11, 2015.

    5. All eligible applicants who have fully and completely complied with the Rules will be deemed to be Potential Participants.  The odds of being selected as a Participant will depend on the total number of eligible Potential Participant applications received during the Application Period and on the Participant Selection Process (defined below).  BMI, acting reasonably, will attempt to contactapplicants who have been selected as Potential Participants by telephone or by email by 5:00 P.M. CT on April 3, 2015, and, at such time, Potential Participants will be provided with the date(s) and time(s) during the Selection Period that he/she will be required to participate in the Selection Process.  Such date(s) and time(s) are subject to change in BMI’s exclusive discretion.  If an applicant who has been selected as a Potential Participant cannot be contacted by 5:00 P.M. CT on April 9, 2015, then that applicant will be disqualified and the Challenge Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard, and, BMI will, in its exclusive discretion, decide whether or not to select another applicant as a Potential Participant in the Challenge. Proof of identification must be provided to the Challenge Sponsors upon request.  The selection and disqualification of applicants, Potential Participants and Participants is and shall be in the Challenge Sponsors’ sole and absolute discretion.

    6. Participants will be selected by BMI, in its sole and absolute discretion, as follows (“Selection Process”).  During the Selection Period, Mike Ciona, one of the hosts of CTV Saskatoon’s CTV Morning Live program, and/or other BMI designee(s) and/or designee(s) of the Challenge Sponsors will meet, in-person, one (1) or more times, in BMI’s exclusive discretion, with each Potential Participant at CTV Saskatoon, 216 First Avenue North, Saskatoon, Saskatchewan S7K 3W3 in order to access and judge each Potential Participant’s overall suitability to be a Participant including without limitation accessing each Potential Participant’s commitment and potential to actively and fully participate in the Challenge in order to improve such Potential Participant’s overall personal health and fitness level.  Up to eight (8) Participants will be selected.  BMI, acting reasonably, will attempt to contactthe Potential Participants selected as Participants by telephone by 5:00 P.M. CT on April 9, 2015.  If an applicant who has been selected as a Participant cannot be contacted by 5:00 P.M. CT on April 13, 2015, then that Potential Participant will be disqualified and the Challenge Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard, and BMI will, in its exclusive discretion, decide whether or not to select another Potential Participant to be a Participant in the Challenge. Proof of identification must be provided to the Challenge Sponsors upon request.  CTV Morning Live hosts, Mike Ciona and Maleeha Sheikh, may each captain a team of Participants and there may be up to four (4) Participants on each team, all in BMI’s absolute discretion. Before being able to participate in the Challenge as a Participant, each Participant will be required to sign and return by no later than 12:00 P.M. CT on April 13, 2015 a full release of rights and waiver of liability form stating that, among other things, he/she has read and understood these official details and rules (“Rules”), grants all consents required, agrees to be available and to actively and in-person participate in the Challenge, agrees to participate in publicity and/or promotions related to the Challenge and/or Challenge Sponsors and/or similar matters, grants to BMI the right to film and record his/her participation in the Challenge and the right to exploit all such filming and recording in perpetuity in any manner and media (now known or hereafter developed) including without limitation in connection with CTV Saskatoon’s CTV Morning Live show, authorizes the Challenge Sponsors to broadcast, publish, disseminate and otherwise use and/or exploit his/her name, city/town/village and province of residence, photograph, likeness, sobriquet and/or voice, in connection with any promotion and/or publicity and/or for general news, entertainment and/or information purposes for no additional consideration beyond Participant’s opportunity to participate in the Challenge, releases the Challenge Sponsors from any and all liability of any kind arising out of or related to the Challenge, including without limitation Participant’s participation in the Challenge, and/or the Challenge Sponsors’ exercise of rights granted to either or both of them by Participant (“Release”).

    7. The Gym pass given to each Participant may not be sold or transferred and is not convertible into cash.  Participants are each solely and exclusively responsible for all costs and expenses related to the Challenge which are not expressly described in the Rules or in the Release.  Without limiting the generality of the foregoing, some examples of such costs and expenses are: transportation to and from the Gym; health and dental insurance; personal expenses; and, costs and expenses relating to clothing, footwear, supplies and equipment necessary and appropriate, in the Challenge Sponsors exclusive discretion, for Participant’s participation in the Challenge.

    8. By applying to be a Potential Participant, the applicants, Potential Participants and Participants automatically agree to accept and abide by these Rules. All decisions of the Challenge Sponsors with respect to any aspect of the Challenge, including without limitation the eligibility of applicants and selection of Potential Participants and Participants, are final and binding on all applicants, Potential Participants and Participants in all matters as they relate to the Challenge.

    9. All applications become property of Challenge Sponsors who assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected applications, mail, voice messages, e-mail and/or any computer errors and/or malfunctions. No correspondence will be entered into except with applicants requesting a copy of the Rules by mail or by email notifying applicants that they have been selected as Potential Participants. Challenge Sponsors do not assume any responsibility for incorrect or inaccurate capture of application information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Application materials or data that have been tampered with or altered are void. If for any reason, in the opinion of the Challenge Sponsors, in their absolute discretion, the Challenge is not capable of running as originally planned, and/or if the administration, security, fairness, integrity or the proper conduct of the Challenge is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Challenge Sponsors reserve their right to cancel, terminate, modify, amend, extend or suspend the Challenge, and select additional Potential Participants from previously received eligible applications and/or select additional Participants. Challenge Sponsors reserve their right to modify the Rules. The Challenge Sponsors reserve their right in their absolute discretion to disqualify any individual they find to be tampering with the application process or the operation of the Challenge or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage any web site related to the Challenge or to undermine the legitimate operation of the Challenge may be a violation of criminal and civil laws and should such an attempt be made the Challenge Sponsors reserve their right to seek remedies and damages to the fullest extent of the law and in equity. Challenge Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Challenge including without limitation any damage to an applicant’s computer equipment, system, software or any combination thereof, as a result of his/her application to be a Potential Participant and/or his/her participation in the Selection Process and/or the Challenge or from downloading any material from any web site related to the Challenge.

    10. The Challenge is subject to all applicable federal, provincial and municipal laws and regulations. By applying to be a potential participant in the Challenge, each applicant consents to the collection, use and distribution of his/her personal information (information that identifies an applicant as an individual, such as home telephone number, age, and home address) by the Challenge Sponsors for the purposes of implementing, administering and fulfilling the Challenge.  Challenge Sponsors will not sell or transmit this information to third parties except for the purposes of administering the Challenge. By applying to be a potential participant, applicants consent to the manner of collection, use and disclosure of personal information as set out in BMI’s Privacy Policy, which is available at http://www.bellmedia.ca/about/Media_Privacy.page.  Any inquiry concerning the personal information held by Challenge Sponsors should be addressed to Bell Media Inc. at 216 First Avenue North, Saskatoon, SK.

    11. In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Challenge related materials, excluding the Release and including but not limited to any point of sale, television, print or online advertising or promotion, the terms and conditions of the Rules shall prevail, govern and control.  In the event of any discrepancy or inconsistency between the terms and conditions of the Release and the Rules, the terms and conditions of the Release shall govern, prevail and control.

    12. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Challenge Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
